The Canterbury Chapter of The Infrastructure Collective (TIC), is pleased to invite you to their panel discussion '3910 Basics - A Beginners Guide' on Thursday 7 November at 5:00pm. Thank you to our event host Anthony Harper Lawyers.

This is a panel discussion about the basics of NZS:3910 – what it is, what it is used for, and what are the key provisions and use of those provisions day-to-day.  We will be joined by Jessica Hanning (Partner - Litigation at Anthony Harper), Tom Angus (Principal Project Manager - Major Projects at WSP) Sarah Anderson (Special Counsel - Construction at Anthony Harper), Chris Wood (Engineer's Representative – Contract Management Team at Christchurch City Council) and Marcus Burrows (Principal Geotechnical Engineer at Stantec). 

The event is targeted at those who are new to working with 3910 and have questions about its application, to more seasoned professionals who want to enjoy either a refresher or get alternative views on aspects of 3910 to understand its application and relevance to other construction industry participants. 

Presenter Details

Jessica Hanning, Partner (Litigation), Anthony Harper

Jessica Hanning is an experienced commercial litigator, with particular expertise in construction. Jessica advises on complex building and construction disputes relating to defective work, delays, payment issues and retentions. She also advises on a broad range of commercial disputes including farm leases, defective product claims, liquidations, and debt recovery.  Jessica has been recognised as a Next Generation Partner in the Legal 500 Asia-Pacific in Construction and Real Estate, and as a Rising Star in the same category in 2020 - 2023. 

Chris Wood, Engineer's Representative – Contract Management Team, Christchurch City Council

I have spent the past 18 years working for CCC in the Contract Management Team.  15 Years as an Engineers Representative both evaluating tenders and supervising and managing a wide variety of multimillion dollar Transport and Roading Contracts. These were all procured and managed against the NZS3910 Conditions of Contract. My role as the Engineers Representative, as defined by CCC, is fundamentally the same as the NZS3910 definition of the Engineer to the Contract, with the exception of reviewing  “Any matters in dispute”. This responsibility would be delegated to the nominated Engineer to the Contract, and who would normally be an employee from an external Engineering Consultant. 

Sarah Anderson, Special Counsel (Construction), Anthony Harper

Sarah specialises in front-end construction and infrastructure law. She drafts, reviews and negotiates contracts to achieve something that is suitable for each project, strikes an appropriate allocation of risk, and which is practical and reflects real life as much as possible.  The types of projects Sarah has worked on recently include the Pūhoi to Warkworth Motorway and several high rise hotel and residential towers in Auckland CBD.  Sarah is a National Councillor for the National Association of Women in Construction.

Tom Angus, Principal Project Manager - Major Projects, WSP

Tom is a Chartered Professional Engineer who specialises in the delivery of major horizontal and vertical infrastructure projects across New Zealand. As a Principal Project Manager in WSP's major projects team, Tom's experience includes the construction phase of the Christchurch Southern Motorway, Metrosports Centre and Earthquake Infrastructure Rebuild. Tom is an accredited Engineer's Representative on NZTA projects and is currently working on the Tauriko Enabling Works project in Tauranga which forms part of the SH29 Tauriko West Road of National Significance project. He is also involved in the procurement of the Te Reinga Bridge replacement and other NZTA projects including the national Weigh Right programme, safety improvements and bridge maintenance projects. He works daily across all aspects of NZS 3910 through his role in administering construction contracts and preparing tender documentation for future projects.

Marcus Burrows, Principal Geotechnical Engineer, Stantec

Marcus is a geotechnical and civil engineer at Stantec New Zealand. His involvement with NZS3910 contacts began about 12 years ago as a graduate on large irrigation canals and pipeline projects in the South Island, undertaken duties of a site engineer and Engineers Representative's assistant. He has since undertaken numerous contacts as the Engineer's Representative or supporting the Engineer ranging from small municipal infrastructure works, to construction of large dams. Marcus' involvement with NZS3910 has been predominantly been during the construction phase and he has spent a significant amount of time on site for civil works.
